Please read these Terms of Service ("Terms") carefully before accessing or using the peppihealth.com website or otherwise using services made available through the Peppi Health platform ("Peppi," "we," "us," or "our").
By accessing or using the Site, creating an account, submitting information, or using services made available through the platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Site or Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or Services.
By using the Site or Services, you represent and warrant that:
You are at least 18 years old.
The information you provide is accurate, complete, and truthful.
You are using the Services for yourself and not for resale or redistribution.
You will comply with all applicable laws and regulations.
Certain treatments or clinical services may have additional eligibility requirements determined by an independent licensed healthcare provider.
2. Nature of Peppi's Services
Peppi operates as a management services organization ("MSO") that provides non-clinical administrative, technology, operational, and support services in connection with services furnished by independent professional medical entities and other third-party service providers. Peppi does not practice medicine, provide medical care, diagnose medical conditions, or prescribe medication.
Clinical services are provided by licensed healthcare professionals through an independent professional medical entity (the "Professional Entity"). The Professional Entity and its healthcare providers are solely responsible for medical evaluations, diagnoses, treatment recommendations, prescribing decisions, and other clinical services. Healthcare providers exercise independent professional judgment, and Peppi does not control or interfere with their clinical decisions.
Where a healthcare provider determines that prescription medication is medically appropriate, prescriptions may be transmitted to and fulfilled by independent, appropriately licensed pharmacies.
Peppi may provide non-clinical services including technology infrastructure, scheduling support, customer support, administrative coordination, communications support, and other management services.
Nothing in these Terms is intended to interfere with or control the independent professional judgment of any licensed healthcare provider.
3. No Guarantee of Prescription or Treatment
Using the Peppi platform or participating in a program does not guarantee that you will receive a prescription or any particular medication or treatment.
A licensed healthcare provider will determine whether treatment is medically appropriate based on your health information, medical history, applicable clinical standards, and applicable law.
A provider may:
Determine that you are not eligible for treatment.
Request additional information or testing.
Recommend a different treatment.
Modify or discontinue an existing treatment.
Decline to prescribe any medication.
Clinical eligibility and prescribing decisions are made exclusively by licensed healthcare professionals.
4. Prescription and Compounded Medications
Some medications that may be prescribed through healthcare providers accessible through the platform may be compounded medications.
Compounded medications are prepared for individual patients by licensed compounding pharmacies pursuant to applicable law. Unless expressly stated otherwise, compounded medications are not FDA-approved, and the FDA generally does not review compounded medications for safety, effectiveness, or manufacturing quality before they are marketed.
The use of any medication involves potential benefits and risks. Your prescribing healthcare provider is responsible for discussing medically relevant risks, benefits, alternatives, contraindications, and appropriate use with you.
Individual results vary. No particular clinical, cosmetic, performance, wellness, or other outcome is guaranteed.
Statements on the Site regarding potential benefits are provided for general informational purposes and do not constitute a promise or guarantee of results.
5. Independent Professional Entity, Healthcare Providers, and Pharmacies
Clinical services available through the platform are furnished by independent licensed healthcare providers affiliated with or engaged by a Professional Entity.
The Professional Entity and its healthcare providers are responsible for:
Evaluating your medical information.
Determining whether treatment is appropriate.
Making diagnoses, where applicable.
Making prescribing and treatment decisions.
Providing clinical advice.
Establishing and maintaining the provider-patient relationship.
Peppi is an MSO and does not direct, control, or interfere with the practice of medicine or the professional judgment of any healthcare provider.
Dispensing pharmacies are independent third parties responsible for matters within their professional and legal responsibilities, including, as applicable:
Compounding and dispensing medication.
Pharmacy-level quality and compliance procedures.
Labeling and packaging.
Storage and handling before shipment.
Dispensing pursuant to a valid prescription.
Peppi may provide administrative and technology support that facilitates communication and coordination among patients, the Professional Entity, healthcare providers, pharmacies, laboratories, and other service providers.
Nothing in these Terms limits any rights you may have under applicable law with respect to a healthcare provider, Professional Entity, pharmacy, or other third party.
6. Account Registration and Patient Information
You may be required to create an account to use certain features or Services.
You agree to provide accurate, current, and complete information and to update that information when necessary.
Because clinical decisions may depend on information you provide, you agree to provide complete and truthful health and medical information, including information regarding:
Current medications.
Allergies.
Medical conditions.
Pregnancy or breastfeeding status, where relevant.
Prior treatments.
Other information reasonably requested by a healthcare provider.
You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.
You must promptly notify us if you believe your account has been accessed without authorization.
7. Pricing and Payment Authorization
Prices and applicable fees will be disclosed before you authorize a transaction.
Depending on the services involved, charges may relate to services furnished by the Professional Entity, pharmacy services or products, laboratory services, technology or administrative services, shipping, or other components disclosed at the time of purchase.
Payment transactions may be facilitated through third-party payment service providers.
By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable service provider and its designated payment service provider to charge that payment method for amounts clearly disclosed to you.
Prices may change from time to time, but a price change will not retroactively alter a charge you have already authorized.
A transaction or service may be declined, canceled, or reversed where reasonably necessary, including because of:
Suspected fraud or unauthorized payment activity.
Payment failure.
Pricing or technical errors.
Regulatory requirements.
Clinical ineligibility.
Product or service unavailability.
Do not send complete payment-card information through ordinary email, text message, or customer-support communications.
8. Recurring Programs and Cancellation
Certain services or programs may be offered on a recurring basis.
If you enroll in a recurring program, the price, billing frequency, and material recurring terms will be disclosed before you authorize enrollment.
By enrolling, you authorize the applicable service provider and its designated payment service provider to charge your selected payment method at the disclosed interval until you cancel or the program otherwise terminates.
You may cancel a recurring program through the cancellation method made available to you or by contacting care@peppihealth.com.
Cancellation prevents future eligible recurring charges but does not automatically reverse charges that have already been incurred or prescription orders that have already entered fulfillment.
You are responsible for canceling before the applicable renewal or processing date if you do not wish to incur the next recurring charge.
A recurring program may be paused or terminated if payment fails, treatment is no longer medically appropriate, medication becomes unavailable, or continuation is otherwise prohibited or impracticable.
9. Prescription Orders, Cancellations, Returns, and Refunds
Because prescription medication is prepared or dispensed for an individual patient and is subject to health and safety requirements, different rules apply to prescription products than to ordinary consumer merchandise.
Before Pharmacy Processing
Where operationally possible, an eligible medication order may be canceled before the prescription or fulfillment order has been transmitted to or processed by the dispensing pharmacy.
If an eligible order is successfully canceled before pharmacy processing, any applicable refund will be handled in accordance with the terms disclosed for the applicable service or transaction.
After Pharmacy Processing
Once prescription medication has entered pharmacy processing, has been compounded or prepared for you, or has been dispensed or shipped, the order generally cannot be canceled, returned, resold, or refunded, except where required by law or where the applicable service provider determines that a refund or replacement is appropriate due to an error or other qualifying circumstance.
Prescription medications should not be returned through ordinary mail unless specifically instructed to do so.
Services Already Provided
Fees attributable to clinical, administrative, laboratory, pharmacy, or other services that have already been performed are generally non-refundable except where required by law or expressly stated otherwise.
Damaged, Defective, or Incorrect Shipments
If you receive a shipment that appears damaged, defective, compromised, or materially different from what was prescribed or ordered, contact care@peppihealth.com within seven (7) days of delivery.
Please retain the medication, packaging, shipping materials, and any temperature-monitoring materials until you receive further instructions.
Photographs or other information may be requested to investigate the issue.
Peppi may assist administratively in coordinating with the dispensing pharmacy or other responsible provider regarding an appropriate replacement, refund, or other resolution.
10. Treatment and Product Availability
Treatments and medications are subject to clinical appropriateness, pharmacy availability, supply conditions, regulatory requirements, and other circumstances that may change from time to time.
No particular medication, formulation, dosage form, pharmacy, or treatment is guaranteed to remain available.
If a medication or service cannot be provided, any applicable charge or refund will be handled by the responsible service provider in accordance with the applicable transaction terms and law.
Where appropriate, you may have the opportunity to consult with a licensed healthcare provider regarding medically appropriate alternatives.
11. Shipping and Delivery
Shipping and delivery estimates are estimates only and are not guaranteed.
Delays may occur because of carrier operations, weather, supply conditions, pharmacy processing, address issues, regulatory requirements, or other circumstances beyond the reasonable control of Peppi or the applicable service provider.
You are responsible for providing a complete and accurate delivery address and for promptly retrieving delivered medication.
Certain medications may have specific storage or temperature requirements. You agree to follow the storage and handling instructions accompanying your medication.
If you believe a medication may have been compromised during shipment or because of a delivery delay, do not use the medication until you have contacted the dispensing pharmacy or an appropriate healthcare provider for guidance.
12. Medical Emergencies
Peppi's Site, messaging tools, customer-support channels, and administrative services are not emergency medical services.
If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency medical attention.
Do not rely on email, chat, text messages, or the Site for emergency medical care.
13. Health and Safety
You agree to use prescription medications only as directed by your prescribing healthcare provider and dispensing pharmacy.
You should promptly communicate relevant side effects, adverse reactions, changes in your health, or questions regarding treatment to an appropriate healthcare professional.
Do not:
Share prescription medication with another person.
Use medication prescribed for another person.
Resell or redistribute medication.
Alter your prescribed treatment solely based on non-clinical website content.
Use medication contrary to your provider's instructions.
Information available through Peppi's public website is intended for general educational and informational purposes and is not a substitute for personalized medical advice from a qualified healthcare professional.
14. No Guarantee of Results
Medical and wellness outcomes vary significantly among individuals.
Peppi does not guarantee that any particular treatment or service will produce any specific result.
Testimonials, reviews, case examples, educational content, and descriptions of potential treatment benefits do not constitute promises or guarantees that you will experience the same or similar results.
Clinical representations made by a healthcare provider in the course of your care are the responsibility of that healthcare provider or Professional Entity.
15. Prohibited Uses and Fraud Prevention
You agree not to use the Site or Services:
For any unlawful, fraudulent, or deceptive purpose.
To obtain medication through false or misleading information.
To obtain medication on behalf of another person unless expressly authorized by law and by the applicable provider.
To resell, transfer, or redistribute prescription products.
To use stolen, unauthorized, or fraudulent payment information.
To interfere with the Site, accounts, security systems, or operations.
To impersonate another person or misrepresent your identity.
To transmit malicious code or attempt unauthorized access to any system.
To engage in conduct that violates applicable law or regulation.
Access may be suspended or terminated, or an order may be canceled, where there is a reasonable basis to suspect fraud, unauthorized payment activity, misuse of the Services, or violation of these Terms.
16. Intellectual Property
The Site and its content, features, functionality, text, graphics, designs, logos, images, software, and other materials are owned by Peppi or its licensors and are protected by applicable intellectual property laws.
Subject to these Terms, Peppi grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use.
You may not reproduce, distribute, modify, commercially exploit, reverse engineer, or create derivative works from Site content except as permitted by law or with our prior written authorization.
17. Electronic Communications
By using the Site or Services, you consent to receive agreements, notices, disclosures, receipts, transaction confirmations, account information, and other communications electronically where permitted by law.
You agree that electronic communications may satisfy legal requirements that communications be provided in writing.
Marketing communications are subject to any additional consent requirements and opt-out rights provided by applicable law.
18. Privacy
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.
Health information may also be subject to additional privacy notices or policies provided by the Professional Entity, healthcare providers, pharmacies, laboratories, or other entities involved in providing services to you.
19. Third-Party and Professional Services
The platform may facilitate access to services furnished by a Professional Entity, healthcare providers, pharmacies, laboratories, payment service providers, shipping carriers, technology providers, and other independent parties.
Those parties may operate under their own terms, privacy notices, professional obligations, and legal requirements.
Peppi is not responsible for the independent professional judgment of healthcare providers or pharmacists.
Nothing in these Terms is intended to make Peppi responsible for acts or omissions of an independent third party where such responsibility does not otherwise exist under applicable law.
20. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and non-clinical services provided by Peppi are provided "as is" and "as available."
Peppi disclaims warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such warranties may lawfully be disclaimed.
Peppi does not warrant that the Site will always be available, uninterrupted, secure, or error-free.
Nothing in this Section is intended to disclaim or limit obligations that cannot lawfully be disclaimed or to alter the professional standard of care applicable to a licensed healthcare provider or Professional Entity.
21. Limitation of Liability
To the fullest extent permitted by law, Peppi and its affiliates, officers, directors, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost data, or loss of goodwill, arising out of or related to your use of the Site or Peppi's non-clinical services.
To the fullest extent permitted by law, Peppi's aggregate liability arising out of or relating to the Site or Peppi's non-clinical services will not exceed the greater of (a) the amount, if any, paid specifically for Peppi's non-clinical services during the six (6) months immediately preceding the event giving rise to the claim or (b) one hundred dollars ($100).
The limitations in this Section do not apply to liability that cannot legally be limited or excluded.
Nothing in these Terms is intended to limit the independent professional responsibility of a licensed healthcare provider, Professional Entity, or pharmacy where such responsibility cannot lawfully be limited.
22. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Peppi and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising out of:
Your material violation of these Terms.
Your fraudulent or unlawful use of the Site or Services.
Your infringement of a third party's rights.
Your intentional misuse or unauthorized redistribution of products obtained through services facilitated by the platform.
This Section does not require you to indemnify any party for conduct for which indemnification may not lawfully be required.
23. Force Majeure
Peppi will not be liable for delays or failures in its non-clinical services resulting from circumstances beyond its reasonable control, including severe weather, natural disasters, epidemics, government actions, regulatory changes, pharmacy or supplier interruptions, carrier disruptions, labor disputes, infrastructure or utility failures, or similar events.
24. Suspension and Termination
Peppi may suspend or terminate access to the Site or its non-clinical services where reasonably necessary because of:
A violation of these Terms.
Fraud or suspected unauthorized payment activity.
Abuse or misuse of the Services.
Safety concerns.
Legal or regulatory requirements.
Conduct that threatens Peppi, its service providers, or other users.
Clinical treatment decisions, including whether treatment should be started, continued, modified, or discontinued, remain the responsibility of the applicable healthcare provider or Professional Entity.
Sections that by their nature should survive termination, including intellectual property, warranty disclaimers, limitations of liability, indemnification, and dispute provisions, will survive.
25. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable federal law controls.
Agreement to Arbitrate
To the fullest extent permitted by law, you and Peppi agree that disputes arising out of or relating to these Terms, the Site, or Peppi's non-clinical services will be resolved through binding individual arbitration rather than in court.
This arbitration agreement does not purport to govern disputes arising solely from medical care furnished by an independent Professional Entity or healthcare provider except to the extent otherwise permitted by applicable law and separately agreed.
This arbitration agreement does not prevent either party from:
Bringing an eligible individual claim in small claims court.
Seeking emergency or preliminary relief where permitted by law.
Pursuing rights that applicable law does not permit to be subjected to mandatory arbitration.
The arbitration will be administered by the American Arbitration Association ("AAA") under the consumer rules applicable to the dispute, unless the parties agree otherwise.
